Republican Senators Threaten ICC Over Possible Israel Arrest Warrants

Facts

  • A dozen Republican senators, led by Sen. Tom Cotton (R-Ark.), have threatened the International Criminal Court (ICC) with sanctions if it proceeds with issuing arrest warrants against top Israeli officials over allegations of war crimes in Gaza.1
  • In a letter to the ICC's chief prosecutor — dated Apr. 24, but only made public by journalists on Monday — the US senators said: 'The United States will not tolerate politicized attacks by the ICC on our allies. Target Israel and we will target you.'2
  • 'If you move forward with the measures indicated in the report,' the letter continued, 'we will move to end all American support for the ICC, sanction your employees and associates, and bar you and your families from the United States. You have been warned.'2
  • While neither Israel nor the US are members of the ICC, as the senators point out in their letter, an investigation saw the court rule in 2019 that it did have jurisdiction to investigate alleged Israeli crimes in the occupied Palestinian territories, dating back to 2014 when Israel last launched an assault on the Gaza Strip.3
  • In November 2023, a month after the Hamas attack on Israel, the ICC expanded its investigation to look at further Israeli attacks on Gaza since.3
  • Last week, while the existence of the Republican's letter was not publicly known, the ICC issued a statement in which it condemned efforts to retaliate or threaten its staff, arguing that this undermines the independence and impartiality of the court, as well as its ability to administer justice.4

As the senators correctly state in their letter, Israel is not a signatory of the Rome Statute and thus, the ICC does not have the jurisdiction to investigate Israeli officials. Should the court attempt to go beyond its well-defined boundaries, the US has every right to take action and prevent this abusive prosecution from taking place.
  • Left narrative, as provided by Zeteo. This type of language from Republicans is more appropriate to the Mafia than US lawmakers. This is clearly intimidation of the ICC that risks severely hampering its independence and impartiality. It also opens the US up to accusations of double standards and hypocrisy after it worked with the ICC to bring charges against Russian officials for actions in Ukraine.
