India: Top Court Suspends Rahul Gandhi's Conviction

India's Supreme Court on Friday stayed senior opposition leader Rahul Gandhi's two-year prison sentence in a criminal defamation case over his remarks about PM Narendra Modi's surname.¹
This case dates back to April 2019, when Gandhi compared Prime Minister Narendra Modi to fugitive criminals by rhetorically stressing that "all thieves" have "the surname Modi" during an election rally — prompting former Gujarat state minister Purnesh Modi to file a private defamation complaint against him.²
Though it observed that Gandhi should have been more careful while making the alleged remarks, the Supreme Court found that "no sufficient reasons and grounds" had been given to impose the maximum punishment for Gandhi.³
The three-judge panel also noted that the ramifications of the conviction were wide and affected the rights of the electorate of Wayanad, Gandhi's constituency, where he was elected as an MP.⁴
Gandhi, who was disqualified as an MP following his conviction, can now return to parliament, attend the ongoing parliament session from Monday, and contest general elections in 2024.⁵
Last month, the country's leading opposition parties formed an alliance known as INDIA to unseat Modi in next year's election. Though the coalition has not yet announced its leader, Gandhi is portrayed as one of Modi's primary challengers.⁶
