Facts

  • The GOP-majority US House on Thursday passed along a party-line 210-205 vote a Congressional Review Act resolution reversing Biden admin. changes to Title IX — including the expansion of the definition of sex discrimination to include discrimination based on gender identity and sexual orientation.1
  • Title IX was enacted in 1972 to prohibit sex-based discrimination in education facilities that receive federal funding. The US Dept. of Education in April revised the rules to include transgender students who aren't called by their preferred pronouns or have their access to school facilities limited.2
  • The new rule also created new protections for pregnant and parenting students, made reporting sexual harassment easier, and required schools to take major actions in response to those reports.3
  • House Speaker Mike Johnson (R-La.) explained the rollback of the protections for transgender students by saying, '...we know Title IX was written to protect the rights of women.' He called the expanded rules 'radical' and said they threaten 'the safety of women's-only spaces.'3
  • The House measure is unlikely to pass in the Democratic-majority Senate and Pres. Joe Biden said he would veto it if given the chance.4
  • The Title IX expansion, which is set to take effect August 1, is facing legal challenges from at least 12 US states. A federal judge in Texas this week responded to one suit by granting a preliminary injunction against it.5
