Dutch, Palestinian NGOs Sue Netherlands over Gaza War

- Dutch, Palestinian, and Jewish NGOs on Thursday filed a suit against the government of the Netherlands, accusing it of failing to prevent Israel from committing possible genocide in Gaza, as well as other violations of international law. Israel has denied the allegations.[1][2]
- Wout Albers, a lawyer working on behalf of the NGOs, told Reuters that the lawsuit seeks to ban all Dutch weapon exports to Israel and halt all business with the country related to its presence in the occupied Palestinian territories. The case is expected to be heard in November.[1][3]
- This comes days after reports that Dutch prosecutors were considering opening a criminal case against senior Israeli intelligence officials for allegedly interfering with the International Criminal Court's (ICC) investigation over possible Israeli war crimes.[4]
- The request in that case was motived by a joint investigation by three media organizations alleging that Israeli intelligence attempted to undermine, influence, and intimidate the ICC chief prosecutor’s office over a nine-year period.[4]
- As the host country of the ICC, the Netherlands is legally obliged to protect the safety and security of ICC staff, and must ensure it is 'free from interference of any kind.'[4]
- Earlier this week, Israel accused ICC prosecutor Karim Khan of failing to give the country adequate opportunity to domestically investigate allegations made against it before seeking arrest warrants for its leaders, stating that this was a violation of the fundamental principles of the ICC’s founding charter.[5][6]
